Robo agravado - Expediente N° 3628-2015

Abstract

De la revisión de la demanda presentada se verifica que la demandante Yadira Castro Ulloa interpone demanda de Reivindicación; en la vía del proceso de conocimiento contra don Manuel Jenaro Torres Rebaza y doña Carmencita Irene Chávez Salinas, que ella es la única y exclusiva propietaria del bien inmueble ubicado en la calle Inca Roca Nª 276-284 (pueblo joven el Porvenir, sector Rio Seco ,Barrio III MZ.13, Lote 7, Distrito El Porvenir, derecho de propiedad tal como la acredita con su escritura pública de compraventa de fecha 7 de enero del 2013 y su respectiva inscripción registral, Nº 14033900 del registro de predio de la Zona Registral Nº V sede Trujillo –oficina Registral Trujillo , la misma que cuenta con un área total de 222.11 metros cuadrados ,así mismo precisa la demandante , que los demandados ocupan el inmueble sub Litis de forma indebida y sin título alguno. La Declaran fundada la demanda de reivindicación interpuesta por doña Yadira Ulloa Castro, contra don Manuel Jenaro Torres Rebaza y doña Carmencita Irene Chávez Salinas; consecuencia ordena que los demandados bojo apercibimiento de lanzamiento en el plazo de seis días hábiles desocupen y entreguen a favor de la demandante el inmueble ubicado en la calle Inca roca Nº 276-284 (Pueblo joven El porvenir, Sector Rio Seco, Barrio 3, Mz 13,lote 07Distrito el Porvenir –Trujillo-La Libertad, inscrito en la partida registral Nº.P1433900del Registro de la propiedad inmueble de la zona Registral Nº v Sede Trujillo, consentida o ejecutoriada que sea la presente resolución, archívese el expediente en el modo y forma de ley.
