Materia Penal: Tenencia Ilegal de Armas de Fuego y Municiones.

Abstract

The present work of professional sufficiency, makes reference to the issues that are subject of support for the obtaining of the title of lawyer, that would come to be CIVIL INTERDICTION AND APPOINTMENT OF CURADOR (file Nº 892-2011-0-1601-JR-FT- 05), and ILLEGAL HOLDING OF FIREARMS AND MUNICIPALITIES (fiscal folder 3113-2016), the issues referred to in the aforementioned professional proficiency work, detail the facts that are the subject of the analysis of cases in the criminal and civil fields; To perform this analysis of the aforementioned cases, I have relied on civil and criminal laws, civil legislation refers to the civil interdiction process and the grounds for being declared an injunction and, criminal legislation refers to the crime of illegal possession of weapons of fire and ammunition, and the budgets typified in said regulations, in turn, I mention the immediate process, which is foreseen in article 446.1 of the Criminal Procedure Code, which would become a special process. The aforementioned work of professional sufficiency to obtain the title of lawyer, is developed with the purpose of making known the procedures and the causes or budgets that are used in civil and criminal matters, object of the analysis of the cases, which makes reference the aforementioned work of professional sufficiency.

El presente trabajo de suficiencia profesional, hace mención a los temas que son materia de sustentación para la obtención del título de abogada, que vendrían a ser INTERDICCIÓN CIVIL Y NOMBRAMIENTO DE CURADOR (expediente Nº 892-2011-0-1601-JR-FT-05), y TENENCIA ILEGAL DE ARMAS DE FUEGO Y MUNICIONES (carpeta fiscal 3113-2016), los temas referidos en el referido trabajo de suficiencia profesional, detallan los hechos materia del análisis de los casos en el ámbito penal y en el civil; para realizar dicho análisis de los citados casos, me he amparado en las legislaciones civil y penal, la legislación civil hace referencia al proceso de interdicción civil y las causales para ser declarado interdicto y, la legislación penal hace referencia al delito de tenencia ilegal de armas de fuego y municiones, y los presupuestos tipificados en dicha normativa, a su vez, menciono el proceso inmediato, el cual se encuentra previsto en el artículo 446.1 del Código Procesal Penal, el cual vendría a ser un proceso especial. El citado trabajo de suficiencia profesional para la obtención del título de abogada, es desarrollado con la finalidad de dar a conocer los procedimientos y las causales o presupuestos que son empleados en las materias civil y penal, 5 objeto del análisis de los casos, que hace referencia el citado trabajo de suficiencia profesional.
