Cambio Automático del Régimen Público al privado y su incidencia en la compensación de tiempo de servicios de los Obreros Municipales.

Abstract

The research we have called “Automatic change from public to private and its impact on Service Time Compensation (CTS) in municipal workers”, it is aimed at determining the legal bases that allow to justify the automatic change of the public regime to the private and its incidence in the CTS at the level of the municipal workers in the District Municipality of El Porvenir. In this sense, the formulation of our Problem was as follows: ¿What are the legal bases for determining the automatic change from the public to the private regime and its impact on the cts, at the level of municipal workers?, in contrast to which we consider the following specific objectives: To know the legal evolution applicable to municipal workers in Peru in the matter of employability; to analyze dogmatic respect for the relevance of CTS in the right of private sector workers regulated by The Single Ordered Text (TUO) of the Service Time Compensation Law approved by Supreme Decree No. 001-97-TR (CTS Law), And investigate the general characteristics of the principles of Primacy of Reality and Irrenunciation of Rights. In application of the various logical and legal methods among them the methods of interpretation, deductive and synthetic, using the technique such as documentary analysis or the filing. It was concluded that there are relevant legal bases to determine the automatic change from the public to the private regime and therefore its impact on the correct application of the CTS, at the level of the workers of the district Municipality of El Porvenir.

La investigación que hemos denominado “CAMBIO AUTOMÁTICO DEL RÉGIMEN PÚBLICO AL PRIVADO Y SU INCIDENCIA EN LA COMPENSACIÓN DE TIEMPO DE SERVICIOS EN LOS OBREROS DE LAS MUNICIPALIDADES”, se orienta a determinar cuáles son los fundamentos jurídicos que permitan justificar el cambio automático del régimen público al privado y su incidencia en la CTS a nivel de los obreros municipales en la Municipalidad Distrital de El Porvenir. En este sentido, la formulación de nuestro Problema fue el siguiente: ¿Cuáles son los fundamentos jurídicos para determinar el cambio automático del régimen público al privado y su incidencia en la CTS, a nivel de los obreros municipales?, frente a lo cual nos planteamos los siguientes objetivos específicos: Conocer la evolución jurídica aplicable a los obreros municipales en el Perú en materia de empleabilidad; analizar la dogmática respecto a la pertinencia de la CTS en el derecho de los trabajadores del sector privado regulado por el Texto Único Ordenado (TUO) de la Ley de Compensación de Tiempo de Servicios aprobado por el Decreto Supremo Nº 001-97-TR (Ley de CTS) e investigar las características generales de los principios de Primacía de la realidad e Irrenunciabilidad de Derechos. En aplicación de los diversos métodos lógicos y jurídicos entre ellos los métodos de interpretación, deductivo y sintético, usando la técnica como el análisis documental o el fichaje; se logró concluir que existen fundamentos jurídicos relevantes para determinar el cambio automático del régimen público al privado y por tanto su incidencia en la correcta aplicación de la CTS, a nivel de los obreros de la Municipalidad distrital de El Porvenir.
