Despenalización del delito de aborto sentimental.

Abstract

The objective of this research is to demonstrate that there is an urgent need to review the typical structure of abortion due to rape in order to correct the gaps or legal deficiencies or otherwise propose an alternative solution to the problem that currently arises in the Doctrine and Jurisprudence, some points will better clarify the issue. From the social point of view, it is necessary to understand that this research aims to reduce the black number of abortions, which have the effect of the risk in the life of the pregnant woman, by practicing abortion in clandestine clinics and without adequate procedures. For this, it has been formulated as a statement: Foundations for the decriminalization of sentimental abortion. Work has been done with the population: Comparative legislation: countries where sentimental abortion is not penalized; and as sample. Comparative legislation: Argentina, Chile, Colombia, Uruguay, Bolivia. The hermeneutical method has been used and as techniques: documentary analysis, and as instruments: a comparative table of comparative legislation and a comparative table of the social impact of the criminalization of this crime and the countries that do not sanction it (Argentina).

La presente investigación tiene como objetivo demostrar que existe la imperiosa necesidad de revisar la estructura típica del aborto por violación con la finalidad de subsanar los vacíos o deficiencias legales o de lo contrario proponer una alternativa de solución frente a la problemática que se presenta actualmente en la Doctrina y Jurisprudencia, algunos puntos aclararán mejor la cuestión. Desde el punto de vista social, es necesario entender que esta investigación pretende reducir la cifra negra de abortos, que tienen como efecto el riesgo en la vida de la gestante, al practicarse el aborto en clínicas clandestinas y sin procedimientos adecuados. Para ello se ha formulado como enunciado: Fundamentos para despenalización del aborto sentimental. Se ha trabajado con la población: Legislación comparada: países que no está penalizado el aborto sentimental; y como muestra. La legislación comparada: Argentina, Chile, Colombia, Uruguay, Bolivia. Se ha usado el método hermenéutico y como técnicas: el análisis documental, y como instrumentos: un cuadro comparativo de la legislación comparada y un cuadro comparativo del impacto social de la penalización de este delito y los países que no lo sancionan (Argentina).
