Abstract

In the present case, the following parties intervened: MAGDALENO JOAQUÍN BLAS e HILDA ORBEGOSO GUERRA, the plaintiffs, who, on September 6, 2010 filed an application for DOMESTIC ACQUISITION REQUIREMENT against the conjugal society formed by VALENTÍN RUÍZ VILLACORTA and CLARA RODRÍGUEZ ÁLVAREZ DE RUÍZ (holders with right inscribed on the property subject of sublitis ), the defendants; whereby the appellants claim to be current owners, also claiming that they bought the property from their previous owners, whose sale consists of a private contract dated November 4, 2002, with signatures legalized before a notary of Trujillo. Thus, the plaintiffs consider to be possessors of good faith, having to date, possession for more than 10 years in a public, peaceful, continuous and as owners of the real property located on the street Mz. "E" Lot 4 of the Natasha Urbanization, District and Province of Trujillo - La Libertad; therefore, they request to be declared proprietors through the demand of Domain Purchase Prescription for having a just title and having exceeded the deadline required to prescribe, if applicable, 05 years. On the other hand, the conjugal society formed by VALENTÍN RUÍZ VILLACORTA and CLARA RODRÍGUEZ ÁLVAREZ DE RUÍZ, opposes the claim filed by the plaintiffs, since they have the ownership of the property in litigation registered in the Registry Item No. 11046045 of the Registries Públicos de Trujillo, noting that they acquired said property in merit to a sale between them and their previous owners, also specifying that they have acted against the appellants in order to have the property restored.

En el presente caso intervinieron las siguientes partes: MAGDALENO JOAQUÍN BLAS e HILDA ORBEGOSO GUERRA, los demandantes, quienes, con fecha 06 de Septiembre del 2010 interponen demanda de PRESCRIPCIÓN ADQUISITIVA DE DOMINIO contra la sociedad conyugal conformada por VALENTÍN RUÍZ VILLACORTA y CLARA RODRÍGUEZ ÁLVAREZ DE RUÍZ (titulares con derecho inscrito sobre el predio materia de sub litis), los demandados; mediante la cual los recurrentes señalan ser poseedores actuales, alegando además que ellos compraron el predio a sus anteriores propietarios, cuya compraventa consta en contrato privado de fecha 04 de Noviembre del 2002, con firmas legalizadas ante notario de Trujillo. Es así pues que, los demandantes consideran ser poseedores de buena fe, teniendo hasta la fecha, la posesión por más de 10 años de forma pública, pacífica, continua y en calidad de propietarios del bien inmueble sito en la calle Mz. “E” Lote 4 de la Urbanización Natasha, del Distrito y Provincia de Trujillo - La Libertad; por lo que, solicitan se les declare propietarios a través de la demanda de Prescripción Adquisitiva de Dominio por contar con justo título y haber superado el plazo requerido para prescribir, en su caso, 05 años. Por su parte, la sociedad conyugal conformada por VALENTÍN RUÍZ VILLACORTA y CLARA RODRÍGUEZ ÁLVAREZ DE RUÍZ, se oponen a la demanda interpuesta por los demandantes, puesto que ellos tienen la titularidad del inmueble en litigio inscrito en la Partida Registral N°11046045 de los Registros Públicos de Trujillo, señalando que adquirieron dicha propiedad en mérito a una compraventa celebrada entre estos y sus anteriores propietarios, precisando además que ellos han accionado frente a los recurrentes a fin de que se les restituya el bien.
