Abstract

From the review of the submitted lawsuit, it is verified that the plaintiff Wilfredo Cruz Reyes alleges joint ownership with his partner Manuela Vigilia Meléndez Tupez of the property located in lot 07 Mz. A of the Urb. El Valle I Stage of the district and province of Trujillo, with an area of ​​153.04 m2 which corresponds to 0.14% of shares and rights of the parent property registered in Electronic Item 11120633 of the Registry of the Real Property of the Registry Area No. V Trujillo Headquarters, for which it files an original accumulated demand for Claim, Accession and Payment of Fruits against Jhon Roly Mendoza Ruiz, requesting the vindication of the real property that is illegitimately occupied by the defendant; the accession of the constructions made on the aforementioned property and the payment of fruits to be paid for the amount of one thousand US dollars per month from the notification of the conciliation request, plus legal interests, costs and costs of the process.

De la revisión de la demanda presentada se verifica que el demandante Wilfredo Cruz Reyes alega ser copropietario juntamente con su conviviente de nombre Manuela Vigilia Meléndez Tupez del inmueble ubicado en el lote 07 Mz. A de la Urb. El Valle I Etapa del distrito y provincia de Trujillo, con un área de 153.04 m2 que corresponde al 0.14% de acciones y derechos del predio matriz inscrito en la Partida Electrónica 11120633 del Registro de la Propiedad Inmueble de la Zona Registral N° V Sede Trujillo, por lo que interpone demanda acumulada originaria de Reivindicación, Accesión y Pago de Frutos contra Jhon Roly Mendoza Ruiz, solicitando la reivindicación de la posesión inmueble que se encuentra ocupado ilegítimamente por el demandado; la accesión de las cons trucciones realizadas sobre el inmueble antes mencionado y el pago de frutos a cancelar por el importe del Mil Dólares Americanos mensuales desde la notificación de la solicitud de conciliación, más intereses legales, costos y costas del proceso.
