Materia Penal:Tenencia ilegal de armas de fuego y municiones

Abstract

Criminal proceeding against Pedro Eleazar CHÁVEZ ROSARIO who is accused of the alleged crime of illegal possession of arms and ammunition to the detriment of the State Public Security, provided for and sanctioned in article 279 of the Criminal Code. In the present case, it occurred as a result of a police intervention made to the accused by the police personnel of Commissioner Nicolás Alcázar of the District of El Porvenir. The present process will be analyzed in its entirety, describing the procedural subjects, as well as the different stages of the process; stage of preparatory, intermediate and trial investigation, as well as the sentence and appeals that occurred throughout the process and the different procedural acts performed as well as the possible acts that could have been carried out; However, for a better understanding, I will proceed to carry out the following dogmatic and legal analysis of the crime of illegal possession of weapons that the defendant is accused of.

Proceso penal seguido contra Pedro Eleazar CHÁVEZ ROSARIO a quién se le atribuye el presunto delito de Tenencia Ilegal de armas y Municiones en perjuicio de la Seguridad Pública del Estado, previstos y sancionados en el artículo 279° del Código Penal. En el presente caso se produjo a consecuencia de una intervención policial hecha al imputado por el personal policial de la Comisaria Nicolás Alcázar del Distrito de El Porvenir. El presente proceso será analizado en su integridad, describiendo a los sujetos procesales, así como los diferentes estadios del proceso; etapa de investigación preparatoria, intermedia y Juzgamiento, así como también la sentencia y apelaciones que se dieron en todo el proceso y a los diferentes actos procesales realizados así como a los posibles actos que se hubieran podido realizar; Sin embargo para una mayor comprensión procederé a realizar el siguiente análisis dogmático y jurídico del delito de tenencia Ilegal de armas que se le imputa al acusado.
