RESPONSABILIDAD CIVIL EXTRACONTRACTUAL DE LOS FUTBOLISTAS - 2021.

Abstract

El presente trabajo de investigación fue desarrollado en la Facultad de Derecho de la Universidad Privada de Trujillo. Su objetivo principal es determinar los presupuestos jurídicos que conllevarían a establecer una responsabilidad civil extracontractual derivada de los daños provocados por un futbolista profesional, durante el progreso de un encuentro de fútbol. Para alcanzar este objetivo se realizó un estudio con los profesionales especialistas en la materia: abogados defensores El tipo de estudio es orientado al cambio y toma de decisiones, el diseño de estudio es Fenomenológico. La investigación cuenta con la variable independiente: Responsabilidad civil extracontractual, y la variable dependiente: Futbolista profesional. Se trabajó con un total de 5 participantes que son abogados defensores; se ha empleado un cuestionario de preguntas cerradas. El estudio permitirá entender el fenómeno social complejo que se aborda, así como comprender posibles aspectos a mejorar en nuestro ordenamiento jurídico nacional. Se concluye que el deportista que sufrió el daño en el desarrollo de un encuentro futbolístico, puede acudir a la vía jurisdiccional en el ámbito civil, y así, poder obtener una sentencia a su favor que contenga una indemnización integral. Además, con ello se asegurará la recuperación absoluta del futbolista afectado, entiéndase por ello tanto su rehabilitación, como también su posterior reinserción a la práctica deportiva.

This research work was developed at the Law School of the Private University of Trujillo. Its main objective is to determine the legal requirements that would lead to establishing a non-contractual civil liability derived from the damages caused by a professional footballer, during the progress of a football match. To achieve this objective, a study was carried out with professionals specializing in the matter: defense lawyers The type of study is oriented to change and decision making, the study design is Phenomenological. The research has the independent variable: Non-contractual civil liability, and the dependent variable: Professional soccer player. We worked with a total of 5 participants who are defense attorneys; a closed question questionnaire has been used. The study will allow us to understand the complex social phenomenon that is being addressed, as well as to understand possible aspects to improve in our national legal system. It is concluded that the athlete who suffered the damage in the development of a football match, can go to court in the civil sphere, and thus, be able to obtain a sentence in his favor that contains comprehensive compensation. In addition, this will ensure the absolute recovery of the affected footballer, meaning both their rehabilitation, as well as their subsequent reintegration into sports practice
