Necesidad de incorporar a los miembros del tribunal como sujetos activos del delito de Prevaricato.

Abstract

Mi investigación giró en torno al tema del prevaricato y la posibilidad de incorporar a los miembros del Tribunal Constitucional como sujetos agentes de este delito, ya que en la actualidad no es posible que se considere a los miembros del Tribunal Constitucional como sujetos activos de este delito en perfecta armonía de los establecido por el rígido principio de legalidad; aunque si existe fundamento para ello, debido a que estos tienen la misma función de administrar justicia, que le asiste a los jueces y fiscales, y por tanto, una conducta como la sancionado en el tipo del articulo 418 lesiona el bien jurídico correcto funcionamiento del al administración de justicia y el deber de lealtad e imparcialidad de la función; y por tanto, deben ser merecedores de pena por este delito. En función a lo descrito en el párrafo precedente se formuló como enunciado del problema: ¿Por qué es necesario incorporar a los miembros del Tribunal como sujetos activos del delito de prevaricato? El objetivo general que fue planteado fue: determinar que es necesario incorporar a los miembros del Tribunal como sujetos activos del delito de prevaricato. Como hipótesis se formuló la siguiente: “es necesario incorporar a los miembros del Tribunal como sujetos activos del delito de prevaricato, debido a que, al igual que los jueces y fiscales, tienen la calidad de magistrados y están encargados de la trascendental función de administrar justicia en materia constitucional en última instancia con la emisión de sentencias que inclusive pueden tener la calidad de precedente vinculante”. Se usó la técnica del análisis documental con la finalidad de registrar los datos e información relevante sobre el tema, que se ha podido extraer de la doctrina nacional. Al mismo tiempo se analizará los pronunciamientos sobre el delito de prevaricato que ha tenido la Corte Suprema de Justicia del Perú. A nivel metodológico se hizo uso del método hermenéutico, el mismo que me facilitó la posibilidad de poder interpretar los alcances del tipo penal de prevaricato, así como del Tribunal Constitucional como institución autónoma.

My investigation revolved around the issue of the prevaricate and the possibility of incorporating the members of the Constitutional Court as agents of this crime, since at present it is not possible to consider the members of the Constitutional Court as active subjects of this crime in perfect harmony of those established by the rigid principle of legality; although there is a basis for this, because they have the same function of administering justice, which assists judges and prosecutors, and therefore, a conduct such as that sanctioned in the type of article 418 damages the correct legal functioning of the to the administration of justice and the duty of loyalty and impartiality of the function; and therefore, they should be worthy of this crime. According to what was described in the preceding paragraph, it was formulated as a statement of the problem: Why is it necessary to incorporate the members of the Court as active subjects of the crime of prevarication? The general objective that was raised was: to determine that it is necessary to incorporate the members of the Court as active subjects of the crime of prevarication. As a hypothesis, the following was formulated: “It is necessary to incorporate the members of the Court as active subjects of the crime of prevarication, because, like the judges and prosecutors, they have the quality of magistrates and are in charge of the transcendental function of administering justice in constitutional matters ultimately with the issuance of sentences that may even have the quality of binding precedent ”. The documentary analysis technique was used in order to record the relevant data and information on the subject, which has been extracted from the national doctrine. At the same time, the pronouncements on the crime of prevaricate that the Supreme Court of Justice of Peru will have been analyzed. At the methodological level, the hermeneutical method was used, which facilitated the possibility of interpreting the scope of the criminal type of prevaricate, as well as the Constitutional Court as an autonomous institution.
