¿Debe ser un requisito que el propietario acredite haber ejercido posesión inmediata del bien inmueble para poder iniciar un proceso de desalojo por ocupación?

Abstract

The present titled research work: MUST IT BE A REQUISITE THAT THE OWNER CREDITS TO HAVE EXERCISED IMMEDIATE POSSESSION OF THE GOOD BUILDING TO BE ABLE TO INITIATE A PROCESS OF EVICTION FOR OCCUPATION? it originates like worry of verifying if the beginning of the process of eviction for occupation must have like requisite the immediate accreditation. The present investigation thinks about how to contribute to the development of the juridical science and contribute major juridical cooking for a suitable application of the process of eviction for precarious occupation, since, in our country there exists a big number of persons that there become proprietary of real estate of way illicit and taking advantage tha eviction process for precarious occupation only is enough to present property title to be able to initiate it, they manage to take possession of the good building, without bearing in mind how he acquired it and why it was not possessing the good building. Finally, I need that, the present investigation will allow us to confirm or reject our hypothesis; and at the same time, it will serve as a precedent for future research, in order to overcome what has been achieved so far. The investigation remains open.

El presente trabajo de investigación titulado: ¿DEBE SER UN REQUISITO QUE EL PROPIETARIO ACREDITE HABER EJERCIDO POSESIÓN INMEDIATA DEL BIEN INMUEBLE PARA PODER INICIAR UN PROCESO DE DESALOJO POR OCUPACIÓN? se origina como preocupación de verificar si el inicio del proceso de desalojo por ocupación debe tener como requisito la acreditación inmediata. La presente investigación busca contribuir al desarrollo de la ciencia jurídica y aportar mayor cocimiento jurídico para una adecuada aplicación del proceso de desalojo por ocupación precaria, dado que, en nuestro país existe un gran número de personas que se vuelven propietarios de inmuebles de manera ilícita y aprovechándose que en el proceso de desalojo por ocupación precaria solo basta presentar título de propiedad para poder iniciarlo, logran apoderarse del bien inmueble, sin tener en cuenta como lo adquirió y por qué no poseía el bien inmueble. Finalmente, preciso que, la presente investigación me permitirá confirmar o rechazar mi hipótesis planteada; y al mismo tiempo, servirá de precedente a futuras investigaciones, a fin de superar lo hasta aquí logrado. La investigación queda abierta.
